1. Introduction and Acceptance
Welcome to the Menusday platform. These Terms and Conditions govern the use of the website menusday.com and any applications, dashboards, interfaces, or digital services associated with it (collectively, the “Platform”).
Creating an account, subscribing to a plan, or using any Platform service constitutes the User’s acceptance of these Terms and Conditions, the Privacy Policy, and any policies or operating rules published on the Platform from time to time. If you use the Platform on behalf of an entity, you represent that you have the legal authority to bind that entity to these Terms.
If you do not agree to these Terms, you must not create an account or use the Services.
2. Definitions
“Menusday” or the “Platform”: the cloud-based system and digital services provided through Menusday, including tools for creating and managing online stores and related services.
“User”: any natural or legal person who accesses or uses the Platform.
“Customer,” “Merchant,” or “Business”: a User who creates a store or business account or subscribes to Menusday services.
“End Consumer”: a customer who purchases a product or service from a store using Menusday.
“Store”: the interface or online store created or managed by the Customer using the Platform.
“Services”: the features, systems, and tools provided by Menusday, whether free or paid.
“Plan”: a subscription plan that specifies features, limits, price, and billing cycle.
“Content”: text, images, products, prices, trademarks, data, files, and any materials uploaded or displayed by a User through the Platform.
“Third-Party Service Provider”: any third party that provides a service integrated with or connected to the Platform, such as payment gateways, hosting, messaging, delivery, and technical services.

4. Description of Menusday Services
Menusday is a cloud-based e-commerce platform that provides businesses and individuals with tools to create, manage, and operate stores and digital services. Depending on the plan and activation, the Services may include:
Creation and management of online stores, products, categories, inventory, prices, and offers.
Management of orders, order statuses, history, and related refund processes.
Delivery management systems, delivery zones, and shipping distances, when included in the applicable plan.
Reservation and event systems and QR code management.
Business-to-business (B2B) commerce tools and retail sales to individuals according to the Customer’s settings.
Dashboards, reports, statistics, and analytics.
Wallets and internal financial transactions when the feature is enabled.
Integration with payment gateways and Third-Party Service Providers.
Search features, working-hours management, payment methods, user management, and permissions.
Any additional features or services launched or made available in the future.
Available features may vary depending on the plan, country, type of business, contractual arrangement, and external integrations. Displaying a feature on the website does not guarantee its availability in all plans or to all Users.
5. Eligibility and Account Creation
The User must have the legal capacity required to enter into contracts or must use the Platform as an authorized representative of an entity.
The User must provide accurate, current, and complete information when registering and update such information whenever it changes.
Menusday may request documents to verify identity, the business, or its activity where required by law or for fraud-prevention purposes.
The User is responsible for maintaining the confidentiality of login credentials and passwords and for all activities conducted through the account, unless an unauthorized breach beyond the User’s control is established and Menusday is promptly notified.
An account may not be shared, sold, or transferred to a third party in a manner that violates the applicable plan, laws, regulations, or Platform instructions.
6. Subscriptions, Plans, and Trial Period
Menusday provides its Services through plans, subscriptions, or offers that may be monthly, annual, or for other periods. A free trial period may be available in accordance with the offer published at the time of registration.
Plan fees, features, and limits apply as displayed to the User at the time of subscription or as stated in the agreed offer or contract.
After a trial period ends, continued use of paid features may require an active paid subscription.
A plan may be upgraded or downgraded where this option is available, and the financial effect will be applied in accordance with the policy displayed when the change is made.
Certain services or add-ons may be subject to fees separate from the basic subscription fee.
Offers and discounts are temporary, are subject to the specific terms of each offer, and do not create a permanent right to a discounted price.
7. Prices, Taxes, and Billing
Subscription and service prices are displayed before a purchase is completed, including an indication of whether tax is included or added in accordance with applicable legal requirements.
The Customer is responsible for fees and taxes legally due on purchases from Menusday unless the offer or invoice states otherwise.
Invoices or receipts are issued electronically based on information provided by the Customer and applicable legal requirements.
The Customer must review billing information, tax number, and business details before an invoice is issued, or request correction subject to available legal and technical capabilities.
8. Payment and Automatic Renewal
Menusday may use licensed or qualified payment gateways and financial service providers to process payments. Payment transactions are also subject to the payment provider’s terms and policies.
If the Customer selects an automatically renewing subscription and agrees to save a payment method or authorizes recurring charges, renewal fees may be charged at the beginning of each billing cycle until automatic renewal is cancelled.
The subscription amount and frequency of charges must be disclosed to the Customer before the subscription is completed.
Automatic renewal may be disabled using the methods available in the account or by contacting support. The subscription remains active until the end of the paid period unless applicable law requires otherwise.
If payment fails, collection may be retried or certain Services may be suspended until the amount is settled, subject to applicable legal requirements.
Menusday does not store full card details where card processing is performed directly by the payment provider. Technical processing details are subject to the actual arrangement with the payment provider.
9. Cancellation and Refunds
Requests to cancel or refund Menusday fees are subject to the nature of the digital service, the stage of its performance, the applicable plan, and any mandatory rights provided by applicable laws and regulations.
The Customer may request cancellation of future subscription renewals at any time using the available methods.
Cancelling renewal does not automatically entitle the Customer to a refund of fees for a period that has already begun or been used, unless the plan policy or mandatory law provides otherwise.
If there is a billing error, duplicate charge, or failure to provide a paid service for a reason directly attributable to Menusday, the Customer may submit a request for review and refund, as applicable.
Any approved refund will, where possible, be returned to the original payment method or by another method determined by Menusday and the payment provider in accordance with applicable rules.
Menusday’s subscription refund policy does not automatically apply to sales transactions between a Customer’s Store and an End Consumer; such transactions are governed by the Store’s policies and applicable laws.
10. Menusday’s Role in Store Transactions
Menusday is a technology platform provider and, unless expressly stated in a specific transaction, is not the actual seller of products or services offered by Platform Customers in their Stores. The Merchant remains responsible to its customers for products, services, prices, inventory, invoices, delivery, warranties, replacements, returns, after-sales service, and compliance with applicable laws.
Menusday does not become a party to the contract between the Merchant and the End Consumer merely by providing technical infrastructure, processing an order, or integrating with a payment gateway, unless a separate agreement expressly provides otherwise.
11. Merchant and User Obligations
Comply with all laws, regulations, and licenses required to conduct the applicable business activity.
Display legally required business information, contact details, policies, and disclosures in the Store.
Ensure the accuracy of product and service descriptions, prices, taxes, shipping charges, and inventory.
Do not sell or offer prohibited, unlawful, or rights-infringing products or services.
Manage customer orders, complaints, returns, replacements, and warranties in accordance with applicable laws and published policies.
Do not use the Platform for fraud, money laundering, deception, impersonation, or transmission of harmful or unlawful content.
Do not attempt to hack the Platform, bypass technical restrictions, or gain unauthorized access to another person’s data or account.
Maintain backup copies of important Content and data where appropriate to the nature of the business.
12. Prohibited Products and Content
Menusday may reject, remove, or suspend any Store, product, or Content that it reasonably believes violates laws, third-party rights, or Platform policies, including fraudulent, misleading, harmful, intellectual-property-infringing, or privacy-infringing Content.
The Customer remains responsible for verifying the legality of the products and services offered and obtaining all required licenses and permits.
13. Content and Intellectual Property Rights
Ownership of Content uploaded by the Customer remains with the Customer or the relevant rights holders.
The Customer grants Menusday a non-exclusive license, to the extent necessary, to host, copy, process, and technically display the Content for the purpose of providing the Services and operating the Store.
The Customer warrants that it holds the rights and licenses necessary to use the Content, trademarks, images, and materials it uploads.
Intellectual property rights in the Menusday Platform, its software, designs, rules, code, trademarks, and original Content belong to their respective owners. A subscription does not grant the Customer any ownership interest in them.
The Platform may not be copied, reverse engineered, disassembled, resold, licensed, or exploited outside the scope of the granted license without written approval.
14. Domain Names and External Integrations
Menusday may enable the connection of domain names or external services. The Customer is responsible for ownership, renewal, and configuration of its domain unless a managed service is agreed. External services are subject to their providers’ availability and terms, and the Service may be affected by changes or outages at those providers that are not under Menusday’s direct control.
15. Payment Gateways and Financial Transactions
Menusday provides technical integrations with payment gateways or payment methods as available. Acceptance, rejection, settlement, and refund of a payment may depend on the payment provider, issuing bank, and relevant financial institutions.
The Merchant is responsible for the accuracy of its account information with the payment provider and for compliance with Know Your Customer (KYC), anti-fraud, and other applicable regulatory requirements.
Payment or refund statuses may appear in the Menusday dashboard based on data received from the payment provider.
Menusday does not guarantee acceptance of every card or payment method at all times or in all countries.
Fees imposed by the payment provider or bank may be separate from Menusday fees unless the applicable offer states otherwise.
16. Delivery and Shipping
If the Customer uses Menusday tools to manage delivery or integrate with delivery companies, the Customer remains responsible for correctly configuring delivery zones, distances, fees, and fulfillment times. If delivery is provided by a third party, transportation is subject to that party’s terms, and Menusday does not guarantee its performance except to the extent of an express contractual commitment.
17. Reservations and Events
When using reservation or event systems, the Customer is responsible for determining schedules, capacity, prices, attendance policies, cancellation and refund policies, and communicating them to beneficiaries. Menusday provides the technical tools and is not responsible for delivering the event or booked service unless Menusday is expressly the service provider.
18. Service Availability and Maintenance
Menusday seeks to provide the Service with a high degree of continuity but does not guarantee absolute uninterrupted availability.
Scheduled or emergency maintenance and security or technical updates may temporarily affect certain features.
Certain features may be modified, developed, or replaced to improve the Service, subject to material contractual obligations.
Menusday is not responsible for failures caused by the internet, Customer devices, telecommunications providers, external services, or force majeure, except to the extent required by mandatory law.
19. Technical Support
Menusday provides technical support through the channels, hours, and service levels published or agreed under the applicable plan. Response priority may vary depending on the nature of the issue and the plan. Unless otherwise agreed, support does not include managing the Customer’s day-to-day business, entering its Content, or providing legal, tax, or accounting advice.
20. Personal Data and Privacy
Personal data is processed in accordance with Menusday’s Privacy Policy and the laws and regulations applicable in the Kingdom of Saudi Arabia, including the Personal Data Protection Law and its implementing regulations, as applicable.
Menusday collects only the minimum data necessary for legitimate and specified purposes related to providing the Service, operating accounts, support, security, and compliance.
In some cases Menusday may act as a controller of Customer account data, and in other cases as a processor of data uploaded by a Merchant concerning its customers, depending on the nature of the processing and contractual arrangements.
The Merchant must ensure that there is a lawful basis for processing its customers’ data, provide privacy notices, and obtain consent where required.
Service providers may be engaged to process data to the extent necessary to provide the Services, subject to appropriate contractual and regulatory safeguards.
Data-subject requests concerning access, correction, destruction, or other rights are handled in accordance with applicable law and the Privacy Policy.
21. Cookies and Tracking Technologies
The Platform may use cookies and similar technologies necessary for account operation, sessions, and security, and may use analytics, preference, or marketing technologies subject to settings and legally required consents. Details should be set out in the Cookie Policy or Privacy Policy.
22. Information Security
Menusday applies reasonable technical and organizational measures to protect systems and data from unauthorized access, use, alteration, or disclosure. Users must also take appropriate precautions, including using strong passwords, limiting employee permissions, not sharing verification codes, and promptly notifying support if a breach is suspected.
23. Backups and Data Retention
Operational retention and backup policies are applied according to the nature of the Service and applicable legal requirements. The Platform is not a permanent archiving service unless the contract states otherwise. When an account ends, certain data may be retained for the period necessary to meet legal obligations or resolve disputes and then destroyed or anonymized in accordance with approved policies.
24. Account Suspension or Termination
Menusday may suspend, restrict, or terminate an account where there is a legitimate reason, including:
Failure to pay fees when due under the subscription terms.
Unlawful or fraudulent use, or use that threatens the security of the Platform or its Users.
A material breach of these Terms that is not remedied within a reasonable period where remedy is possible.
A request from a competent authority or a legal obligation requiring suspension.
Use of the Platform in a manner that causes serious technical or legal harm to the Platform or third parties.
Where possible, and where doing so does not compromise security or violate a competent authority’s direction, Menusday will seek to notify the Customer of the reason for suspension and provide a reasonable opportunity to remedy the breach.
25. Effects of Subscription Expiry
Access to paid features ends upon expiry of the subscription term or in accordance with the cancellation terms.
A limited period may be made available to export or recover data in accordance with the plan and applicable technical policies.
Termination of the account does not release the Customer from payment of amounts due before the termination date.
Provisions that by their nature are intended to survive termination will continue to apply, including intellectual property, confidentiality, dispute resolution, and accrued liabilities.
26. Confidentiality
Each party must protect non-public information obtained from the other party through the contractual relationship, use it only to perform the Services or meet legal obligations, and disclose it only to employees or contractors who need to know it and are bound by confidentiality, or where disclosure is required by law or an order of a competent authority.
27. Limitation of Liability
To the extent permitted by applicable law, Menusday is not liable for indirect or consequential losses, loss of anticipated profits, or loss of business opportunities arising from use of the Platform, particularly where the cause is outside its reasonable control or arises from the conduct of the User or a third-party provider.
Nothing in these Terms shall be interpreted as excluding or limiting liability that cannot legally be excluded or limited, nor shall these Terms prejudice mandatory rights granted by law to consumers or data subjects.
28. Indemnification for Third-Party Claims
To the extent permitted by law, the Customer is responsible for claims or damages arising from its Content, products, services, violation of laws, or infringement of third-party rights, and shall indemnify Menusday for costs and damages finally awarded or lawfully agreed where they arise directly from such violation, while allowing the Customer to defend the claim in accordance with appropriate procedures.
29. Force Majeure
Neither party shall be liable for delay or non-performance caused by events beyond its reasonable control, including natural disasters, widespread telecommunications or power outages, large-scale cyberattacks, governmental decisions, epidemics, or other force majeure events, for the duration and to the extent of their impact.
30. Notices and Electronic Communications
Menusday may send account, billing, security, update, and service notices by email, SMS, app notification, or dashboard. The User is responsible for keeping contact information current. Marketing communications are subject to legally required consent and opt-out options.
31. Amendments to the Terms and Services
These Terms may be updated as necessary due to service development or changes in legal, regulatory, or operational requirements. Where a change is material, the User will be notified by an appropriate method before it takes effect where required or practicable. Continued use of the Service after an amendment becomes effective constitutes acceptance to the extent permitted by law.
32. Assignment and Transfer
The Customer may not assign its material rights or obligations under these Terms to another party without Menusday’s approval, except where permitted by law. Menusday may transfer the contract or part of its operations to an affiliate or legal successor as part of a restructuring or acquisition, while preserving the Customer’s legal rights.
33. No Waiver of Rights
A party’s failure or delay in exercising any right does not constitute a waiver of that right and does not prevent its later exercise.
34. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the effect shall be limited to that provision to the extent necessary, and the remaining provisions shall continue in effect unless the fundamental purpose of the agreement can no longer be achieved.
35. Entire Agreement
These Terms, together with the Privacy Policy, subscription policy, applicable offer or specific contract, and any approved appendices, constitute the agreement governing use of the Services. In the event of a conflict, a specific contract or offer prevails on matters it expressly governs, followed by these Terms, subject to mandatory provisions of applicable law.
36. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws and regulations applicable in the Kingdom of Saudi Arabia. The parties will first seek to resolve any dispute amicably within a reasonable period. If no resolution is reached, jurisdiction shall lie with the court or competent authority in the Kingdom of Saudi Arabia, without prejudice to any mandatory jurisdiction established by law for consumers or regulatory authorities.
37. Governing Language
Translations of these Terms may be provided in other languages for convenience. In the event of any discrepancy in interpretation, the Arabic version shall be the authoritative version unless applicable law requires otherwise.
38. Contact and Complaints
For inquiries or complaints concerning Services, subscriptions, billing, or accounts, Users may contact the approved support channels on the Menusday website. For legal or privacy matters, a dedicated and clearly identified email address should be published in the service-provider information and Privacy Policy.
Please include the account or Store number, a description of the issue, the transaction number where applicable, and any supporting documents to help expedite the request.
39. Special Provisions for Menusday Customer Stores
Every Customer using Menusday to create an online Store must publish its own Terms and Conditions, Privacy Policy, return/replacement policy, and shipping policy appropriate to its business and must not rely on Menusday’s Terms as a substitute for its Store’s terms. This document governs the relationship between Menusday and Users of its Platform; it is not the Merchant’s terms of sale to the End Consumer.
40. Acknowledgment
By using the Menusday Platform, creating an account, or purchasing a subscription, the User acknowledges that they have read, understood, and agreed to comply with these Terms, that the information provided is accurate, and that they have the necessary authority to contract if acting on behalf of an entity.
